Freehold Conversion Policy for Multi Storied Commercial Complexes, Buildings

DDA Freehold Conversion

Delhi Development Authority has started conversion of individual Flats / floors / shops in multistoried Residential and Commercial Complexes in Delhi from lease hold to free hold on payment of applicable. conversion charges.

The scheme is applicable for all Flats/ floors / shops in multistoried Residential and Commercial Buildings and Complexes.

The applicant is required to pay one time charges for conversion from leasehold to freehold. The charges have to be paid in lump-sum. A surcharge of 33.33% on the conversion fee would be payable over and above the normal conversion charges.

Individual flats / floors / shops in mult-storied residential, commercial and mixed land use complexes shall be allowed conversion from leasehold to freehold in cases where the owners have complied with the following conditions.

a) Lessor had obtained permission for construction of multistoried group housing com­plexes and multi-storied commercial complexes and has also complied with the bye laws and regulations laid down by the Central, State & lo­cal bodies;
b)The building plans had been sanctioned by the local body 
c)The purchaser will have to provide proof of his ownership rights such as registered General Power of Attorney / Agreement to Sell / Sale agreement / Sale deed. 

Further preconditions shall be as under;

The conversion application has to be made by a person holding a valid power of attorey from the lessee/sub lessee/ allottee to sell / transfer the property.

The applicant has to give Proof  of physical  possession of the property.

Where there are multiple / chain of power of attorneys, conversion will be allowed only after verifying the factum of physical possession provided that the linkage of original lessee/sub lessee allottee with the last power of attorney is established and attested copies of power of attorneys are submitted;

Conversion of individual flats/floors/shops in such complexes will be allowed only after payment of proportionate amount of outstanding dues like ground rent, misuse charges etc. in respect of the entire property as a whole plus the dues that are attributable to the particu­lar flat / shop which is sought to be converted to freehold

In case the property is re-entered or in case its lease has been cancelled,  such properties will not be eligible for the conversion unless the re-entry is withdrawn after pay­ment of all dues such as misuse charges and damage charges for the unauthorized construction.
