A lease refers to a transaction under which an owner of a property (the landlord) lets out his property to another ( the tenant). A Lease Deed or a Lease Agreement incorporates the terms and conditions of this lease between the lessor and the lessee as per which the lessee agrees to pay periodic rent to the lessor for the use of his immoveable property.
As per the provisions of the Registration Act, 1908, it is compulsory to get a lease deed for a term of more than 1 year registered in the Sub Registrar office after paying the applicable stamp duty on it.
The lease deed needs to be executed both by the lessor and the lessee.

Important points to note in relation to registration of Lease Agreement in Noida are as follows :
1. Stamp duty is payable @ 2 % of the average annual rent in the case of lease agreements for a term of upto 1 year and @ 2% of the total rent for first 3 years in case of lease agreements for a term of greater than 1 year, but upto 5 years.
3. Both the Lessor / Landlord(s) and Lessee / Tenant(s) have to present themselves before the Noida Sub Registrar for the execution and registration of the Lease Agreement alongwith their two passport size photographs and identification documents .
4. The Presence of two witnesses alongwith their two passport size photographs is also required in the Noida Sub Registrar Office for the Registration of Lease Deed / Lease Agreement.
